FDA's Role in the Problem:
The FDA has engaged in censorship of truthful health claims, restricting the ability of companies to share scientific information about healthy foods, supplements, and certain off-label drug uses. This has included cases where the FDA sent warning letters to companies selling foods like cherries and walnuts, prohibiting them from making factual statements about their health benefits. The FDA brought criminal charges against those who made claims for coenzyme Q10 (CoQ10), even though the claims were based on peer reviewed published research that have since been validated in confirmatory studies.


Legislators can advocate for the Free Speech about Science Act, which aims to protect truthful, non-misleading health claims from FDA censorship. This would allow companies to share peer-reviewed research with the public without fear of regulatory retaliation. Additionally, Congress should enforce First Amendment protections against arbitrary FDA speech restrictions.
